The trademark at issue was filed for goods of 18-th class such as purses, wallets, umbrellas.

The Taiwanese Intellectual Property Organization (TIPO) rejected the trademark application, which consisted exclusively of graphic elements as it decided such continuous and infinitely extendible pattern can be regarded as the ornamental pattern on the goods rather than a sign identifying the manufacturer.

The IP Court sustained the TIPO decision that the trademark is not distinctive enough.
